The event formed part of an ongoing collaborative initiative between the Department of Social Justice and Transformation (SJT), the Research Directorate and the Centre for Academic Development (CAD), aimed at creating platforms for socially responsive research and critical engagement.

Welcoming attendees, Acting Transformation Manager and lecturer in the Department of Tourism and Integrated Communication, Mr Teboho Bojabotseha, explained that the seminar series was established to provide postgraduate researchers with an opportunity to share not only their academic work, but also the lived realities and challenges shaping their research journeys.

“We embarked on this initiative to afford staff pursuing postgraduate studies a platform to share with the VUT community what research they are doing, the kind of challenges they are experiencing, and how the institution could assist them,” said Mr Bojabotseha.

At the centre of the seminar was Ms Louise Japhta, a lecturer in the Department of Legal Sciences within the Faculty of Human Sciences, whose doctoral research examines the precarious realities faced by transgender inmates in South African correctional facilities.

Her presentation, titled “Law in the Shadow of Ungrievability: A Critical Analysis of the Carceral Production of Ungrievable Trans Lives”, challenged attendees to confront difficult questions about equality, institutional systems and the limits of constitutional protection.

Drawing from six years and eight months of experience as a Manager of Legal Services at the Department of Correctional Services, Japhta reflected candidly on how her professional experiences inside the prison system shaped both her worldview and research focus.

“Correctional services were my foundation, but it was also a learning school for me. There, I learned which manager I do not want to be,” she shared.

Her research interrogates why transgender inmates continue to experience exclusion, discrimination and institutional vulnerability despite South Africa’s constitutional commitment to equality, dignity and Human Rights protections.

“What happens to a person?” Japhta asked during her presentation. “You have all the constitutional rights at your disposal, you have all the legislative protection available to you, but still you are not recognised by the system.”

Throughout the seminar, Japhta explored themes of vulnerability, institutional discrimination and what philosopher Judith Butler describes as “ungrievable lives”, referring to lives society fails to fully recognise, protect or value. She explained that transgender inmates often experience heightened vulnerability because correctional systems continue to operate within rigid male and female classifications.

“One of the biggest problems is that prison systems are built on strict male and female categories,” she explained. “When a transgender person enters that system, the institution struggles to recognise them.”

Her presentation also highlighted landmark legal matters, including the Jade September and Makuna cases, both of which challenged the treatment of transgender inmates within correctional facilities. These cases raised critical concerns around gender expression, solitary confinement, access to healthcare and institutional discrimination.

Moving beyond legal frameworks, Japhta’s research also examined the enduring impact of colonialism and apartheid era systems on gender non-conforming individuals in South Africa. She argued that many of the exclusionary structures still present today are deeply rooted in colonial laws and imported social systems.

“We did not always have a problem with transgender people in Africa,” she noted. “Those tensions intensified during colonialism when rigid laws and systems were introduced.”

What made the seminar particularly compelling was its refusal to remain purely theoretical. Japhta consistently brought the discussion back to human dignity, institutional accountability and the lived experiences of vulnerable individuals navigating systems that often fail to recognise their humanity.

The seminar sparked meaningful engagement among attendees, with conversations extending beyond the formal presentation into broader discussions around prison reform, inclusivity, constitutional rights and the responsibility institutions carry in protecting vulnerable communities.

As VUT continues to strengthen spaces for critical dialogue and socially responsive scholarship, the seminar served as a reminder that research is not only about generating knowledge, but also about confronting uncomfortable realities, challenging systems and advancing conversations capable of driving meaningful social transformation.

“The Vaal University of Technology (VUT) hosted a postgraduate
